APPENDIX A
GENERAL PROVISIONS FOR INCLUSION IN ALL CONTRACTS

  1. So far as is practicable the Contractor shall employ Bahraini staff and Labour provided that the Contractor shall not recruit or attempt to recruit his personnel and labour from amongst persons already in the service of the Government. When specially qualified persons are not available in Bahrain then the Contractor may employ persons not normally resident in Bahrain. The entry of such persons shall be governed by the procedures laid down in the legislation of the State of Bahrain concerning the entry of aliens.

  2. The Contractor shall admnister all workers in strict compliance with the Labour Law for the Private Sector, Amiri Decree No. 23, 1976, as amended. The Contractor shall be responsible for the observance of the terms of this sub-clause by any sub-contractor.

    1. If any doubt, difference or dispute arises between the contracting government agency and the Contractor concerning the interpretatlon or implemnentation of any of the provisions of an Agreement/Contract, or the performance or failure of performance of any obligation hereunder, then either party may give notice to the other party of its desire to negotiate a settlement under thin provisions of this clause.

    2. Any doubt, difference or dispute that cannot be settled by mutual agreement within thirty days after notice under para (a) of this clause has been given by either party to the other shall be referred to a committee of three members, one to be selected by the contracting government agency, one to be selected by the Contractor, and the third to be selected either (a) by mutual agreement between the government agency and the Contractor or, in default of such agreement , ( b ) by the Bahrain Minister of Justice.

    3. A decision of the comittee on any matter referred to it under this clause shall be final and binding on both the contracting government agency and the contractor.

    3. The parties will advise one another immediately of any charge in their respective postal addresses or telex numbers.

    1. This Contract shall be governed by the law for the time being in force in the State of Bahrain.

    2. All dates and periods mentioned or referred to in this Agreement should be reckoned according to the Gregorian Calendar.
