ELIGIBILITY FOR NON JOB RELATED ALLOWANCES
AND LEAVES FOR GOVERNMENT EMPLOYEES
DURING ABSENCES DUE TO WORK INJURY
- PURPOSE:
To describe an employee’s salary and benefits status and the procedures for ministries to follow whenever an employee is absent due to work injury.
- AUTHORITY:
Resolution No. 16 for 1992 dated 22 September 1992 of H. H. The Prime Minister, Chairman of the Civil Service Council, regarding eligibility for non job related allowances and leaves to government employees during absences from work due to work injury.
- DEFINIITION:
A work injury is an injury stated in article (54) law no 13 for 1975 Reorganizing Pension and Indemnities of Government Employees and Workers and its Amendments.
- POLICY
An employee while absent from work because of a work injury is legible for compensation from the Pension Fund Commission equivalent to his basic salary and from the employing ministry for non job related allowances such as social, inducement, housing and academic.
The period of absence will be considered active duty time for other service benefits such as accrual of annual leave and sick leave, and regular step increments, final entitlements, and length of service recognition.
- RESPONSIBILITIES
- The Civil Service Bureau is responsible for setting policy and providing guidance to ministries regarding the status of and benefits to employees who are absent because of a work injury.
- Ministries are responsible for keeping their managers, supervisors and employees informed about the provisions of this regulation, for notifying concerned authorities of accidents and employee work injuries, for following up with other concerned authorities to make sure that the employee receives the proper salary compensation and job related allowances when due, and for compliance with this regulation and Pension Fund Commission instructions.
- PROCEDURES:
- Ministries will forward to the Civil Service Bureau in accident cases over one day the following completed forms in addition to CSB Form 32, Accident Report Form (issued by Civil Service Circular No 2, Series 710, on 30 May 1992).
- CSB Form 52 requesting a temporary stop in salary effective the day following the day of injury.
- CSB Form 60 to request and authorize the Pension Fund Commission to pay to the employee compensation equivalent to his basic salary less any amounts that can be deducted From the compensation and to pay the deductions to the concerned agencies
- CSB Form 61 to pay the employee his non-job related allowances from the ministry’s budget.
- When it is not possible to stop the employee’s salary because the absence started after the payroll has been processed or the employee has already received his salary, adjustments can be made between the ministry and the Pension Fund Commission through the Civil Service Bureau.
- The ministry will submit to the Civil Service Bureau a CSB Form 52 requesting that regular pay be started the date the employee returns to duty.
- CONTRACT EMPLOYEES:
- An Employment Agreement (Contract) will not be terminated while the employee is absent due to work injury. The conditions of the Agreement will be suspended during the absence only in terms of service time. The service tune will begin again on the date the employee returns to work after recovery; or the Agreement will, be terminated on the date the employee is separated as permanently disabled or on the date of death, whichever is earlier based on the report of the Medical Commission. All other Contract conditions and benefits remain in force while the employee is absent due to work injury. If the employee returns to work, they period while the Contract was suspended will be added to extend the Contract by that period. The Ministry and the employee may also agree to extend, renew or terminate the Employment Agreement according to the terms of the Agreement.
- All benefits of the Contract also remain in force during the absence due to work injury such as salary compensation, non job related allowances, accrual of annual and sick leave and other entitlements
