NIGHT WORK (WOMEN)

Purpose: This regulation is issued to inform Ministries of the limitations of scheduling women to work at night, and to implement the provisions of International Labour Organization Convention Mo. 89: Might Work (Women)

2. Policy:
a.No female shall be employed to work in any public industrial undertaking or in any branch thereof between the hours of 8 p.m. an4 1 a.m. except in the following circumstances:

  1. In cases of emergency situations when there occurs an interruption of work which it was impossible to foresee, and which is not of a recurring character;
  2. In cases where the work has to do with raw materials or materials in course of treatment which are subject to rapid deterioration when such night work is necessary to preserve the said materials from certain loss;
  3. In cases of women holding responsible positions of a managerial or technical character;
  4. In cases of women employed in health and welfare services who are not ordinarily engaged in manual work.

b. For the purpose of this regulation, the term “industrial undertaking” includes:

  1. Undertakings engaged in the generation, transformation or transmission of electricity or motive power of any kind; and
  2. Undertakings engaged in building, and civil engineering work, including construction,repair, maintenance, alteration and demolition work.

3. Responsibilities
a. Ministries will assure that the limitations described herein are adhered to.

b. The Civil Service Bureau will provide advice and assistance to the Ministries in resolving questionable cases brought to its attention.
